A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17C-15-51, relating to requiring motor vehicles, trailers, or semitrailers having a hydraulically operated bed to have a warning device that will alert the operator when the vehicle is in motion and the bed is in an upward position; and requiring rulemaking.

Be it enacted by the Legislature of West Virginia:


ARTICLE 15.  EQUIPMENT.


§17C-15-51.  Hydraulic lift warning device.

(a) On or before January 1, 2019, every motor vehicle, truck, trailer, or semitrailer having a hydraulically operated bed shall include a warning device that will alert the driver in the event the bed is in an upward position when the vehicle is in motion.

(b) The Commissioner of the Division of Motor Vehicles shall propose rules for legislative approval in accordance with §29A-3-1 et seq. of this code to implement this section.

 

NOTE: The purpose of this bill is to require motor vehicles, trailers or semitrailers having a hydraulically operated bed have a warning device that will alert the operator when the vehicle is in motion and the bed is in an upward position. The bill requires rulemaking.
